Terms of Service

SubliminalsTV is a creator brand focused on Star Citizen, flight simulation hardware, gaming, streaming, community content, tools, guides, and related creator projects.

For these Terms, “SubliminalsTV,” “we,” “our,” and “us” refer to the SubliminalsTV brand and its operated Services.

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with permission from a parent or legal guardian.

By using the Services, you represent that you meet these requirements and that your use of the Services complies with applicable law.

Some Services may require an account or may connect to a third-party account, such as YouTube, Twitch, Discord, Patreon, Ko-fi, or another platform.

You are responsible for:

• Providing accurate account information.
• Keeping login credentials secure.
• All activity that occurs under your account.
• Promptly notifying us of unauthorized access or security issues.

We may suspend or terminate accounts that violate these Terms, create risk, abuse the Services, or infringe the rights of others.

You agree not to:

• Use the Services for unlawful, harmful, deceptive, abusive, harassing, or fraudulent purposes.
• Attempt to disrupt, overload, reverse engineer, scrape, attack, or compromise the Services.
• Upload or transmit malware, spam, phishing content, or malicious code.
• Impersonate another person or misrepresent your affiliation with any person or entity.
• Infringe copyrights, trademarks, privacy rights, publicity rights, or other rights.
• Bypass access controls, rate limits, security measures, or platform restrictions.
• Use automated systems to access the Services unless we clearly allow it.
• Interfere with other users' enjoyment of the Services or SubliminalsTV communities.

The Services may allow comments, posts, form submissions, uploads, messages, bug reports, feedback, gameplay submissions, configuration files, or other user-provided content (“User Content”).

You retain ownership of your User Content. By submitting User Content, you grant SubliminalsTV a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, modify, excerpt, publish, distribute, and otherwise use that content as needed to operate, promote, and improve the Services and related SubliminalsTV content.

You are responsible for your User Content and represent that you have the rights needed to submit it. We may remove or moderate User Content at our discretion.

The Services, including videos, streams, designs, text, graphics, logos, software, tools, templates, documentation, and other materials created by or for SubliminalsTV, are owned by SubliminalsTV or its licensors and are protected by intellectual-property laws.

You may not copy, modify, distribute, sell, sublicense, or exploit SubliminalsTV content except as allowed by these Terms, a separate license, platform functionality, or written permission.

You may share links to public SubliminalsTV content and use reasonable excerpts for commentary, criticism, news, or other legally permitted uses.

Some SubliminalsTV applications, tools, widgets, data projects, or experiments may be provided as early access, beta, preview, or community tools.

Beta and experimental features may change, break, lose data, produce inaccurate output, or be discontinued at any time. You should not rely on them for critical, safety-sensitive, financial, legal, or production decisions.

If the Services allow purchases, subscriptions, memberships, donations, commissions, or digital goods, payments may be processed by third-party providers. Your transaction may also be governed by that provider's terms.

Unless otherwise stated at checkout or required by law:

• Digital goods, memberships, donations, and downloadable products may be non-refundable.
• Prices, features, and availability may change.
• We may refuse or cancel orders where fraud, abuse, error, or policy violations are suspected.

Giveaways, contests, sweepstakes, promotions, partner offers, and affiliate campaigns may have additional rules. If there is a conflict between these Terms and promotion-specific rules, the promotion-specific rules control for that promotion.

No purchase is necessary to enter a giveaway unless the official rules clearly state otherwise and applicable law permits it.

SubliminalsTV may participate in sponsorships, affiliate programs, product reviews, discount codes, partner campaigns, or other monetized creator relationships.

We aim to disclose material relationships clearly. Product opinions, recommendations, and commentary are based on creator judgment, experience, research, or disclosed partner context, but you are responsible for evaluating whether any product, software, game package, hardware, or service fits your needs.

The Services may integrate with or link to third-party platforms, products, websites, game services, social platforms, payment processors, analytics services, hosting providers, or community tools.

We do not control third-party services and are not responsible for their content, policies, security, availability, or practices. Your use of third-party services is governed by their own terms and policies.

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, SubliminalsTV disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the Services will be uninterrupted, secure, error-free, accurate, complete, or available at any particular time. Content related to games, hardware, software, pricing, specifications, availability, or third-party platforms may change without notice.

SubliminalsTV content is for informational and entertainment purposes unless expressly stated otherwise.

To the fullest extent permitted by law, SubliminalsTV and its owners, operators, contributors, contractors, partners, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or service interruption.

To the fullest extent permitted by law, our total liability for any claim related to the Services will not exceed the greater of:

• The amount you paid directly to SubliminalsTV for the relevant Service in the 12 months before the claim; or
• USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to defend, indemnify, and hold harmless SubliminalsTV and its owners, operators, contributors, contractors, partners, and service providers from claims, damages, liabilities, losses, costs, and expenses arising from:

• Your use or misuse of the Services.
• Your violation of these Terms.
• Your User Content.
• Your violation of law or third-party rights.

We may suspend, restrict, or terminate access to the Services at any time if we believe you violated these Terms, created risk, caused harm, infringed rights, abused the Services, or acted unlawfully.

You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute terms.

We may modify, pause, discontinue, or replace any part of the Services at any time.

We may update these Terms from time to time. The updated version will be posted with a new effective date. Continued use of the Services after changes become effective means you accept the updated Terms.
